A Worksafe investigation has found that Higgins Contractors Limited’s “multiple failings” to implement traffic management or assess the necessary precautions “subsequently led to the loss of three lives”.

Haki Hiha, 40, David Eparaima, 55, and Soul Raroa, 55, were killed on Matata straights, Bay of Plenty, in February 2019, in an accident with truck driver David Cox.

Simon Humphries, Worksafe’s Head of Specialist Interventions, concluded from the investigation that Higgins had not made sure to put traffic management in place before beginning work. The roadworkers were hence left with no protection.

Higgins Contractors was sentenced on August 21 for neglecting their duty as a business and putting workers at risk, under the Health and Safety at Work Act 2015.
