- Acceptance of Terms
- By clicking “Accept”, “I Agree”, or similar, or by accessing or using the Website, or by creating an account, you agree to these Terms & Conditions (the Terms) and our Privacy Policy ([insert link]).
- If you do not agree, do not click “Accept” and do not otherwise use the Website.If you accept on behalf of an organisation, you confirm you have authority to bind that organisation.
- In these Terms, a reference to “you” includes, as context requires, a reference to:
- you and the organisation you represent; or
- you or such organisation.
- NRSPP Program Partners and the Charter
- Organisations may apply to become NRSPP Program Partners in accordance with the NRSPP Governance and Operating Charter, as amended from time to time, including all documents and guidelines incorporated or referenced therein (Charter). The current version of the Charter may be accessed via this Link.
- If you become a NRSPP Program Partner, you agree to comply with the Charter in addition to these Terms.
- Charter obligations apply only to NRSPP Program Partners, not to general Website users.We may revoke NRSPP Program Partner status if these Terms or the Charter are breached.
- We may revoke NRSPP Program Partner status if these Terms or the Charter are breached.
- You may terminate your organisation’s status as a NRSPP Program Partner by emailing mailto:NRSPP-Admin@monash.edu with the reason(s) your organisation no longer wants to be a NRSPP Program Partner. For the avoidance of doubt, termination of an organisation’s status as a NRSPP Program Partner does not terminate or otherwise vary any agreements between us and you or the organisation you represent.
- If your organisation ceases to be a NRSPP Program Partner, for any reason, you must immediately stop representing yourself as a NRSPP Program Partner and remove all NRSPP-related branding, including logos, imagery, livery, and any other identifiers, from any website, marketing materials, social media, vehicles, uniforms, and any other medium. You must not make any statement or implication that suggests you remain a NRSPP Program Partner or are certified, endorsed, accredited, or otherwise affiliated with us.
- Partner Measures Assessment Tool (PMAT)
- The PMAT is an online tool available only to users with an account.
- Completing the PMAT is required to become a NRSPP Program Partner and must be repeated annually to maintain that status.
- After completing the PMAT, you will receive:
- a report showing your organisation’s results, recommended areas for self-nominated actions and NRSPP resources to assist in the development or improvement in relation to certain themes; and
- a certificate confirming that your organisation is a NRSPP Program Partner that has completed the PMAT for that year.
- Any report generated by the PMAT, including any results, findings, analysis, resources, guidance or recommendations therein (PMAT Report) is provided for general information purposes only. While some content may be tailored based on your responses, you agree the PMAT Report:
- does not constitute legal, financial, technical, or other professional advice;
- does not certify compliance with any standards (including safety standards);
- does not imply that your organisation is authorised, accredited, endorsed, or qualified to perform any activity; and
- should not be relied upon as a substitute for obtaining independent professional advice.
- We make no warranties or guarantee as to the accuracy, completeness, or suitability of any PMAT Report for your purposes (or any particular purpose). To the maximum extent permitted by law, you assume sole responsibility and risk in interpreting, using or exploiting the PMAT Report.
- You agree the certificate:
- only confirms PMAT completion and NRSPP Program Partner status;
- does not certify compliance with any standards (including safety);
- does not imply authorisation, accreditation, or endorsement; and
- does not guarantee capability or qualification to perform any activity.
- You must, to the best of your knowledge, ensure all PMAT Data (as such term is defined below) you provide is accurate and not misleading.
- PMAT Data
- The PMAT will collect your responses to the questionnaire, which consists of multiple-choice questions, (PMAT Questionnaire Data) and any self-nominated actions you submit (including any documents uploaded to support such self-nominated actions) (PMAT Self-Nominated Actions Data) (collectively PMAT Data).
- We will use PMAT Data for:
- assessing NRSPP Program Partner eligibility;
- the generation or creation of PMAT Reports related to your organisation;
- monitoring compliance with the Charter;
- aggregated, anonymised reporting for program evaluation; and
- legal or regulatory compliance.
- Use of Partner Logos
- By becoming an NRSPP Program Partner, you grant us a non-exclusive, royalty-free licence to display your organisation’s name and logo:
- on the Website to identify you as a current NRSPP Program Partner; and
- in a social media post welcoming new NRSPP Program Partners.
- We will not use your logo for other purposes without your consent.
- If your NRSPP Program Partner status ends, we will remove your logo from the Website within a reasonable time.
- By becoming an NRSPP Program Partner, you grant us a non-exclusive, royalty-free licence to display your organisation’s name and logo:
- Permitted Use of the Website
- The Website and Content is provided for lawful purposes only in accordance with these Terms.
- You agree that you are solely responsible for all costs and expenses you may incur in relation to your use of the Website or any Content.
- We make no promise that the Website is appropriate or available for use in locations outside of Australia. If you choose to access the Websites from locations outside Australia, you acknowledge you do so at your own initiative and are responsible for compliance with local laws where they apply.
- You must not:
- upload harmful, unlawful, or infringing material to the Website;
interfere with the Website’s security or functionality; - publish, distribute, transmit, sell, license or download the whole or any part of the Website or any Content (except caching or as necessary to view the Website) for any commercial purpose (for the avoidance of doubt, merely downloading or transmitting Content by or on behalf of a for-profit entity shall not be a commercial purpose per se);
- use the Website, or any Content, to publish or send malicious content (such as phishing, viruses, harmful code or Trojans), with the intent to compromise our or another user’s account, security, identity, IT environment or to breach confidentiality;
- use the Website or any Content to publish or send spam (unsolicited commercial electronic messages), or any other commercial communications;
- use the Website for any unlawful purposes, fraud, or to conduct or promote illegal activities; or
infringe our or another person’s Intellectual Property Rights or moral rights.
- upload harmful, unlawful, or infringing material to the Website;
- We may restrict access to account-based features if these Terms are breached or for security or legal reasons.
- User Content
- You retain ownership of any content you upload (User Content).
- You grant us a non-exclusive, perpetual, royalty-free licence to use, store, and display User Content as needed to operate the Website and its tools.
- You warrant that you have the right to upload the content and that it does not breach any law or rights (including Intellectual Property Rights and moral rights).
- We may remove User Content that we reasonably consider unlawful or harmful.
- Intellectual Property
- In these Terms:
- Content means any materials, tools or content on the Website or that contribute to the existence and the “look and feel” of the Website, including information, graphics, questionnaires, forms, headers, icons, images, logos, names, sounds, music, video, audio, text, software, HTML and code; and
- Intellectual Property Rights includes patents, rights to inventions, copyright, trademarks, trade names and domain names, rights in goodwill, rights in confidential information and any other intellectual property rights, whether registered or unregistered and including all applications for, and renewals or extensions of, such rights and all similar rights which subsist now or in future anywhere in the world.
- The Website and the Content (and all Intellectual Property Rights comprised therein) are owned by us, or in some cases, our affiliates, partners, related bodies corporate or licensors. The Intellectual Property Rights are protected by Australian and international laws.
- You are not granted any rights, including any Intellectual Property Rights, in relation to, or permitted to use, any part of the Content or the Website, other than as expressly authorised by us, our third-party licensors or applicable laws, such as the Copyright Act 1968 (Cth).
- Any unauthorised publication, reproduction, exploitation, distribution, duplication, copying, including to another server or location, sale, access, modification or use of any part of the Website or any Content is prohibited.
- Unless you have our prior written consent, you are expressly prohibited from:
- using any automated process, software, or script to extract, scrape, crawl or collect data or Content in any manner, including but not limited to the use of web crawlers, bots, or spiders;
- aggregating, collecting, or compiling Content for commercial or non-commercial purposes. This includes, but is not limited to, the use of Content to create databases, directories, or other aggregated content; and
- using any artificial intelligence (AI) tools, machine learning algorithms, or other automated technologies to analyse, process, or generate content based on or through the use of the Content. This includes, but is not limited to, using the Content to (i) train AI models (ii) for any form of automated content generation and (iii) as input to an AI system, as a prompt, request, question, instruction or similar.
- By accessing and using this Website, you agree to comply with these restrictions. Any attempt to bypass these restrictions may result in legal action and/or termination of access to the Website

- any PMAT Report; or

- This exclusion applies regardless of the cause of the Loss other than where caused by our negligence, fraud or wilful misconduct, in which event our liability shall be limited to the proportion to which we contributed to such Loss.
- You agree to exercise your own skill and judgment when using the Website and any of the materials referred to in paragraphs (b)-(d) in clause 11.1 above. We recommend that you carefully assess the accuracy, currency, completeness, and relevance of all Content and any PMAT Reports for your specific needs. To the fullest extent permitted by law, you and your organisation release us from any and all liability in connection with your use of or reliance on such materials other than where caused by our negligence, fraud or wilful misconduct in which event our liability shall be limited to the proportion to which we contributed to such loss.
- To the fullest extent permitted by law, we disclaim all liability for any loss, damage, liability, cost, or expense (Loss) incurred by you, your organisation, or any other party arising from, or otherwise in connection with, the use of or reliance on:
- Termination and Account Suspension
- We may suspend or terminate your account and access to account-based features (including the PMAT) if:
- you breach these Terms (including, for clarity, the Charter);
- you provide false or misleading information;
- you misuse the Website or the Content;
- you fail to complete the PMAT annually; or
- we are required to by law.
- Upon termination, your right to use account-based features ends, and we may delete your account data.
- We may suspend or terminate your account and access to account-based features (including the PMAT) if:
- Changes to Terms and Discrepancies
- To the extent there is any inconsistency or discrepancy between these Terms and the Charter, these Terms take precedence to the extent of such inconsistency or discrepancy.
- We may update these Terms at any time by posting the revised version on the Website.
- Continued use means you accept the updated Terms.
- Governing Law
- If any part of these Terms is found to be void, unlawful, or unenforceable then that part will be deemed to be severed from the balance of these Terms and the severed part will not affect the validity and enforceability of any remaining provisions.
- These Terms will be governed by and interpreted in accordance with the laws of the State of Victoria, Australia, without giving effect to any principles of conflicts of laws
- You agree to the jurisdiction of the courts of the State of Victoria, Australia to determine any dispute arising out of these Terms.
